Toyota fucks cars up, fatal consequences.
Ashley Boyle now will have no justice. There has been new information released from toyota for a recall of over 10 million vehicles due to unintended acceleration issues. They have posted a recall list of all of the vehicles. Unfortunately, the man's vehicle was on the list and had 2 reported similar issues prior to the accident with my mother. The other incidents didn't result in any injuries or deaths. Now, the state attorney must drop the charge of dui manslaughter to a misdemeanor dui, because the state will not be able to prove it beyond a reasonable doubt. March 22nd will most likely be the last hearing/sentencing where the charge will be dropped to the misdemeanor dui and he will plead guilty and be sentenced. I could try suing toyota but because just llike in this criminal case they can not prove whether it was the driver's fault or the vehicle's fault, so I am pretty sure it's just gonna be a waste of my time and effort to pursue it. there is record of cases being dismissed due to driver error and since he was drunk they will most likely do the same. I will still be calling some lawyers in california that have more experience with these problems. But honestly, I think it's just gonna be a waste of time. Toyota announced Dec 26th 2012 they would being settling for economic losses due to the unintended acceleration malfunction, but that does not include personal injury or wrongful death.
