Teen accused in jogger case to be tried as an adult

GREAT FALLS (AP) - A teenager accused of deliberately running over a jogger so he could have sex with the corpse will be tried as an adult, District Judge Kenneth Neill said Thursday.

Sixteen-year-old Daniel Lee Robbins is charged with the attempted murder of 40-year-old Patty Emanuel, a stranger he struck with his sport utility vehicle in May while she was jogging near C.M. Russell High School.

Defense lawyer Steve Hudspeth fought to have the case remain in Youth Court so Robbins could receive mental health care outside the state prison system.




However, the judge said in his ruling that treatment of Robbins as an adult "does not mandate incarceration."

Neill said he took into account the previous testimony of psychiatrist William Stratford. The doctor said Robbins knew what he was doing when he hit Emanuel with the intent to kill her and have sex with her body but his ability to appreciate what he'd done "was severely impacted due to a deteriorating psychotic mental condition."

Stratford recommended Robbins be treated in a secure facility, for the protection of the community, until he's at least 21 and possibly longer.

If convicted as a youth, Robbins could be held only until he turns 18 _ about 15 months from now _ and then placed on probation until he's 21. As an adult, he faces from 10 year to life in prison.

Neill ruled that, given the nature of Robbins' alleged actions and various time factors, it would be in the community interest to try him in District Court.

Robbins remains in custody at the juvenile detention center and a trial date will be set later.

Why is it that the anti-death penalty types are so quick to bring up such inhumane torture as an alternative to capitol punishment?

Inhumane? That is what is in prisons. THAT is what capitol punishment is. Prison is having your life taken away and having to live in hell. It's not inhumane, Six-Gun, it's just. And if I were that woman who got hit and then fucked while I was a corpse, then that's the punishment that I'd want the asshole to have.

You got it right that a person does forfiet their life when the committ such heinous crimes. But torture and rape are not appropiate.

A swift death is very appropiate. It does not take much time, nor does it burden the taxpayers when capitol punishment is used like it should be.
A lifer is a useless drain on both taxpayers and natural resources. On this overpopulated planet of diminishing resources, we really can't afford that nonsense.

You are right about being overpopulated and not affording it... But I still believe it's just. If we didn't have to waste our tax dollars on such pricks, I say leave them be in hell.

As whacked out as it sounds I think they should put them in the army or something. Give them a good disciplining there, get them trained to be government bitches, they've already got the mentality of a killer so then troops wouldn't come home with mental problems from having watched men die and having killed men.

But the disciplinining part would be the hardest. I still think it'd be more productive for them than jail.

hmmm I have to say I disagree sini, people like that in the military is why there’s war crimes and stories of rape during times of war.....this kid had a car and you think we should give him a gun. SAdly I agree with six gun ...it be wrong to pay to keep some one like that for the rest of his life just because we think it's more humane then death. Jail won't help some one like that, but make them worse.

No. I think the army might be a good place for delinquents with no structure in their lives and too much time on their hands, but you don't put nutjobs in there. Prison it must be. Possibly metal prison, I don't know what they'll decide about his sanity.

So, you would rather see the person who committed the crime be put to death as quickly as possible while they may have killed someone in the most horrid way imaginable? If you rape a six year old, cut her up while she is alive and then mail her parts to her parents you should have the same death, minus the mailing of organs. Fuck letting them off easy. Can you imagine being in jail for 30+ years? I would chew through my wrist to kill myself.

Kill em, why should we pay taxes to keeps sick son of a bitchs like this one in prison to be butt raped till he's let out to undoubtably do it again?!
