Correct me if I'm wrong. Downloading music or recording your favorite radio station is violating the terms of a copyright license or copyright infringement. Stealing property or a CD from a music store is theft as it deprives a person of their property. While copyright infringement is clearly illegal, it may be inaccurate to describe it as theft.
It's a matter of criminal case (theft,stealing) vs a civil case (copyright infringement). | |

Ah, I didn't know you could record songs from the radio legally. There doesn't seem to be much difference between recording metallica off of a radio and downloading it. I mean, the end would be the same.
When you download a song illegally you are not depriving a person of their property. If you download a song or you don't download a song or you don't buy the song, you aren't depriving someone of money, a CD, a tangible good. However, it is a violation of a copyright. | |

And there is a large difference, when you put something on the air its fair game, since those are public airwaves. The internet is not the same since most of the data is stored on private servers etc. If the data on a private server is stolen data, its theft to download it. Kind of like if you come to me and I give you a bunch of items I stole, you're still accepting stolen goods which is illegal.
And just because something isn't tangible, doesn't mean it cannot be stolen. And when you illegally download something you are depriving the artist or owner of the data of their right to control their copy-written private information. Which usually means you're robbing them of their right to earn a profit from their hard work. Profit by the way is where is becomes tangible. | |

Who is it you think you're stealing from when you're downloading? Because unless it's some powerhouse-dynasty like Metallica or Tool, most bands don't see shit from album sales or merchandise sales. The only money that the bands see is from whatever the record company buys their album for and from doing shows.
And with the music industry the way it is these days (building their own dynasties, force feeding pop-culture, and tryin' to screw over the real bands [because it is an industry, and they run it like one . . . often suing bands that break-up for not fulfilling their 6 album contract]) it's no wonder that most bands really do want people to download their shit. I can't tell you how many albums I've downloaded from a band's website. Some bands put up all of their albums so you can download them.
Most musicians these days have their own recording equipment. A basic kit will only run you a couple of thousand dollars. They record their music, post it online, hope people download it and decide to come out to their shows. And if they get really popular, they might have a large enough fan-base that they can afford to spend a few grand making merchandise so fans might buy it.
Downloading isn't going to go away. People will continue to do it . . . and there's many tricks to it. But for the artist, rather than bitching about it, they need to embrace it and find a way to use it. Some bands already have, finding a larger fan base than a record company could offer. And the industry has even jumped into the game with itunes and shit. So, in the end . . . downloading can be beneficial. I was masturbating
