There is a 15{ish} page document that has all the lawyer written rules.
But basically, he needs to have, in his possesion, copies of everyones birth certs and ID's to prove that any given person who posts a pic in the [adult] forum, is over 18 and who they say they are.. Plus have proof that everyone who visits the [adult] forum is at least 18. You wanna give him Your credit card info and pay for it? LOL
OH, and some of the ad companies won't let you have adult stuff on your site either if you wish to be involved with them....
But thats the short version.

Actually, it's quite acceptible. I'm working on getting an adult section, and having to jump through all kinds of hoops. It sucks. I can totally see why Garg decided not to fuck with it.

this baffles me--i don't frequent paid porn sites, but i'm quite sure they don't require a copy of your birth certificate for membership. Or maybe i'm wrong. But, that seems like it would cut down on business.

I am pretty sure it amounts to local law. Wherever the server is physically located are whatever laws can apply. Here in Utah for example you cannot run a pornsite I am pretty sure. Or buy real beer in a regular supermarket 
Hell, in Massachusetts you cannot run a tattoo parlor, you probably cannot run a porn site from there either 
I can however buy unregistered firearms here in Utah from private individuals and go anywhere there is wilderness and discharge them whenever I want
