I've got to admit, at least half the things that get sued for over there would just be laughed out of court here - people would literally laugh in your face for trying to sue. See, over here, if we don't like something we just don't go back/buy it/eat there again - we're known as the nation of silent complainers apparently: if we have something wrong with our holiday/meal/purchase/whatever, English people tend to simply not do it again rather than complain about it, ergo losing the person at fault business. I think it's tied to the whole English reserve thing, where the English don't seem to like to make a fuss about anything, whereas we all know the Americans like to make a fuss about everything
