Does this mean I can sue all the microbreweries in my town for the same thing? After all, beer isn't supposed to be nutty or fruity, or taste good, so that must mean they're marketing to children, right?
Frivolous? No, I don't think so. To me, a frivolous lawsuit is when a guy is allowed to sue a homeowner for medical coverage of the injuries he sustained while breaking in to rob the place.
Is it well-intentioned? Maybe, but it's also stupid. We have laws in place against the selling of alcohol to those under the age of 21 in the U.S. To my knowledge, Anheiser-Busch isn' t violating those laws. Their products aren't marketed during children's programming; they don't have "Hannah Montana" or "Spiderman" on the labels. Bars and store still card.
Kids will drink anything. I don't see anyone suing the Florida Orange Growers Association because their product is being used to make vodka taste better...or Red Bull because their product has been incorporated into mixed drinks.
