That would depend. If you are a spiritual person, and believe in the existance of the human soul, and that it is the true human identity, then it could be said that the body is the property of the soul. In that case, assuming a "finders-keepers" moral stance, you could be simply taking posession of unclaimed property, but relatives probably get the body first.
